How to File for Chapter 7 Bankruptcy

Since Chapter 7 bankruptcy will automatically discharge your consumer debts, a good deal of the process involves gathering information and presenting that information to give an accurate account of your financial status. At my firm, I will advise you to gather documents that include:

  • Income information and pay stubs
  • All financial statements and bank records
  • Copies of debts that are owed to credit card companies, medical providers and others
  • Tax returns
  • Any correspondence from creditors and collection agencies
  • Other pertinent financial information

Together, we will look at this information, create a budget and look at where your money is going. We will get a handle on what you can afford, where you may be able to cut back and whether proper financial planning could help you more than filing for bankruptcy.

I will also help you determine if you qualify for Chapter 7 bankruptcy through the means test. Many lawyers will not discuss specifics of your situation without charging you hundreds of dollars. I'll do the means test with you for free so you know right away if you qualify.

If we determine that bankruptcy is the right solution, I will provide resources for credit counseling, which is mandatory under federal bankruptcy law. Once this is completed, we can file for bankruptcy, and hopefully, complete the process in an efficient manner.
